CPI / Affaire Laurent Gbagbo et Blé Goudé : l’audience du procès en appel du 27 mai prochain annulée
Comme il fallait s’y attendre, l’audience du procès en appel de l’affaire le procureur contre Laurent Gbagbo et Charles Blé Goudé prévue pour se tenir du 27 au 29 mai prochain a été annulée.
Les juges de la chambre d’appel avaient soumis la tenue de l’audience à des conditions. Les différentes parties devraient s’entretenir avec le greffe afin de régler tous les aspects techniques pour une audience virtuelle à cause du Covid-19.
La défense de Blé Goudé avait demandé l’annulation de l’audience pour trois raisons. Premièrement, la Défense soutient que toute audience orale qui se tiendrait virtuellement violerait le droit de M. Blé Goudé à être présent à l’audience. Deuxièmement, la Défense soutient qu’une audience virtuelle empêcherait le Co-conseil, M. N’Dry, de communiquer librement et en toute confidentialité avec M. Blé Goudé, ce qui constituerait une violation du droit de M. Blé Goudé au titre de l’article 67, paragraphe 1, point b), du le Statut. Troisièmement, la Défense soutient qu’une audience virtuelle empêcherait le public de suivre la procédure, constituant ainsi une violation du droit de M. Blé Goudé au titre de l’article 67, paragraphe 1, du statut.
Quant au procureur Fatou Bensouda abordant dans le même sens invitait à son tour la chambre de reporter l’audience.
« Compte tenu des nombreux défis opérationnels et techniques en suspens deux semaines et demie avant l’audience prévue et compte tenu de la nature fondamentale des droits en cause, le Procureur a de sérieuses préoccupations quant à la possibilité de tenir une audition significative et efficace sur les dates prévues et convient qu’à ce stade, le report par la Chambre peut être la meilleure option jusqu’à ce que les questions soient résolues de manière satisfaisante et appropriée », avait suggéré l’ancienne ministre gambienne.
Les différentes parties sont désormais à l’attente de la décision motivée de l’annulation l’audience par la chambre d’appel avant une nouvelle programmation.
