Me CLAUDE MENTENON, Avocat du Président Laurent GBAGBO, EXPLIQUE LA DECISION DE LA COUR AFRICAINE DES DROITS DE L’HOMME…” C’est une ordonnance, c’est-à-dire une décision provisoire prise par la Cour africaine des droits de l’homme et des peuples, en attendant qu’elle statue sur le fond sur la requête de Laurent Gbagbo.
La Cour ordonne donc à la Côte d’Ivoire de « suspendre la mention de la sanction pénale du casier judiciaire » de Laurent Gbagbo, et « de prendre toutes les mesures nécessaires en vue de lever immédiatement tous les obstacles empêchant le requérant de s’inscrire sur la liste électorale ». Sur le fond donc, Laurent Gbagbo conteste sa radiation de la liste électorale. Ses recours en août dernier avaient tous été rejetés en Côte d’Ivoire. Il a par conséquent donc saisi le 7 septembre la Cour africaine.
Sa radiation de la liste avait été entraînée par une condamnation en son absence à 20 ans de prison pour l’affaire dite du « braquage de la BCEAO », par la justice ivoirienne en janvier 2018, alors qu’il était détenu à La Haye par la CPI. UNE VICTOIRE DONC POUR L’ANCIEN PRESIDENT IVOIRIEN. Pour autant sa radiation n’était que l’un des trois arguments avancés par le Conseil constitutionnel pour justifier le rejet de sa candidature à la présidentielle. Les juges avaient aussi invoqué le fait qu’il n’avait pas signé en personne sa déclaration de candidature. Et qu’il n’avait pas non plus expressément renoncé à son statut de membre de droit du Conseil constitutionnel, autre motif d’irrecevabilité de candidature.
La Côte d’Ivoire, qui refuse d’appliquer les décisions de la Cour africaine et qui a entamé le retrait de sa déclaration de compétence, ne s’est pas fait représenter à l’audience. C’est une décision satisfaisante pour les intérêts de mon client, parce que pour lui, il était essentiel que ce droit fondamental fut reconnu.”Claude Mentenon, avocat de Laurent Gbagbo et ancien bâtonnier de l’ordre des avocats sur RFI .
